Working with Counsel

David Medical Services provides independent expert witness services to attorneys involved in jail and prison healthcare litigation nationwide.


Our process is designed to be efficient, professional, and defensible, with clear communication and respect for litigation timelines.

Who We Work With

We are retained by:


  • Plaintiff attorneys in civil rights and wrongful death matters
  • Defense counsel representing counties, municipalities, and correctional entities
  • Private correctional healthcare organizations and their counsel


Our role is neutral and objective. We provide medical analysis, not advocacy.

Initial Introductory Call

The first step is a brief introductory call with our correctional healthcare expert physician. This call allows counsel to:


  • Describe the allegations and procedural posture
  • Confirm whether the case is within scope
  • Discuss timeline and urgency
  • Clarify records available or pending
  • Determine next steps for engagement

There is no obligation to retain following the call.

Scope of Engagement

Once retained, we may assist with:


  • Comprehensive medical record review
  • Standard-of-care analysis
  • Causation opinions (when appropriate)
  • Written expert reports prepared for litigation use
  • Deposition testimony
  • Trial testimony when needed


We do not provide tactical law enforcement opinions, legal conclusions, or psychiatric diagnostic testimony outside appropriate scope. 

Medical Records & Materials

To ensure efficient review, counsel is typically asked to provide:


  • Complete jail / prison medical records
  • Relevant hospital or EMS records
  • Autopsy reports (if applicable)
  • Facility policies or protocols (when relevant)
  • Complaint and key pleadings (helpful but not required)


We will clarify exactly what is needed, based on the case being reviewed.

Written Expert Reports

Our expert reports are:


  • Clearly structured and organized
  • Grounded in evidence-based medicine
  • Informed by accepted correctional healthcare standards
  • Written in plain, defensible language for legal audiences


Reports are prepared with deposition and trial use in mind.

Depositions & Testimony

Dr. Ryan D. Herrington, MD, MPH has extensive deposition experience and has also provided live courtroom testimony when required.


We approach testimony with:


  • Professional demeanor
  • Clear explanation of medical concepts
  • Consistent, well-supported opinions
  • Respect for the court and counsel on both sides

Neutrality & Objectivity

David Medical Services provides independent, evidence-based medical opinions. We are not outcome-driven and do not tailor opinions to advocacy goals. Our credibility depends on objectivity, and we take that seriously. This approach serves both counsel and the court.

Timelines & Communication

We understand litigation deadlines. Typical expectations include:


  • Clear discussion of timeline before engagement
  • Realistic turnaround estimates based on record volume
  • Direct communication regarding scope changes or additional needs


Urgent matters may be accommodated when feasible.

Fees & Retainer

Fee structure and retainer requirements are discussed transparently after the introductory call and prior to the engagement. Rates reflect:


  • Physician expertise and experience
  • Complexity of the matter
  • Scope of review and reporting
  • Deposition or trial involvement
