Opioid & Alcohol Withdrawal Death Expert Witness

For Jail and Prison Litigation Nationwide

David Medical Services provides independent expert witness services in cases involving withdrawal-related injury or death in custody, including allegations of inadequate detoxification care, methamphetamine intoxication mismanagement, failure to monitor, and failure to provide appropriate treatment.

We are retained by both plaintiff and defense counsel to provide objective medical opinions, written reports, and testimony when needed.

Correctional Withdrawal Deaths Are Often Preventable

Deaths related to opioid or alcohol withdrawal remain among the most serious and preventable adverse outcomes in custody settings.

These cases frequently involve questions of:

  • Proper intake screening and risk identification
  • Timely recognition of escalating withdrawal severity
  • Adherence to accepted detoxification protocols
  • Appropriate medication management
  • Clinical monitoring and escalation of care
  • Continuity of treatment for individuals already receiving medication-assisted treatment (MAT)

Our role is to clarify whether the care provided met accepted medical and correctional healthcare standards.

Case Types Commonly Reviewed

Alcohol Withdrawal Deaths

These cases include seizures, delirium tremens, and failure to provide appropriate monitoring or escalation of care.

Opioid Withdrawal and Inadequate Treatment

These cases include failure to assess severity, inadequate symptom management, and preventable deterioration.

Failure to Follow Detox Protocols

These cases involve instances in which facilities do not adhere to established withdrawal management policies or monitoring requirements.

Discontinuation of Medication for Opioid Use Disorder (MOUD/MAT)

These cases include failure to continue medications such as:

  • Buprenorphine
  • Methadone
  • Naltrexone (when appropriate)

Abrupt discontinuation of MAT in custody may raise significant clinical and legal concerns, particularly when associated with worsening withdrawal, relapse risk, or serious outcomes.

Delayed Transfer to Higher Level of Care

These cases include failure to send patients to the emergency department or hospital when medically indicated, including methamphetamine and other substance intoxication.

Common Allegations in Withdrawal Death Litigation

These cases often involve claims such as:

Failure to treat serious medical needs

Deliberate indifference under §1983

Negligence or wrongful death

Inadequate medical screening at intake

Failure to monitor or respond appropriately

Systems breakdowns in correctional healthcare delivery

We provide objective analysis grounded in evidence-based medicine and the realities of custody settings.
