Use-of-Force Injury & Death Expert Witness

For Jail and Prison Litigation Nationwide

David Medical Services provides independent expert witness services in cases involving serious injury or death in custody following use-of-force incidents, including allegations of excessive force, restraint-related harm, and inadequate medical response.

We are retained by both plaintiff and defense counsel to provide objective medical opinions, written reports, and testimony when needed.

Medical Issues in Use-of-Force Cases

Use-of-force incidents in correctional settings may raise complex medical questions regarding:

  • Mechanism and severity of injury
  • Physiologic deterioration following restraint
  • Medical response and timeliness of care
  • Appropriateness of clinical monitoring after force events
  • Contribution of intoxication, withdrawal, or underlying illness
  • Causation in serious injury or death cases

Our role is to clarify the medical findings, standards of care, and clinical response in custody environments.

Scope of Expert Review

We provide medical expert analysis related to:

Injury documentation and clinical interpretation

Medical causation and contributing factors

Post-incident assessment and monitoring

Emergency response and escalation of care

Standards of correctional healthcare following force events

We do not provide tactical or law enforcement "force justification" opinions, but rather medical analysis of injury, physiology, and healthcare response.

Case Types Commonly Reviewed

Serious Injury Following Restraint or Force

Cases include head trauma, positional compromise, or medical collapse after physical restraint.

Deaths in Custody After Use of Force

These include cases where medical causation is disputed or multifactorial.

Delayed or Inadequate Medical Response

These cases include failure to provide timely evaluation, EMS activation, or transfer to higher level of care.

Co-Occurring Withdrawal, Intoxication, or Medical Vulnerability

These include cases where substance withdrawal or underlying disease increases physiologic risk during or after restraint.

Documentation and Communication Failures

Cases include incomplete medical assessment or breakdowns between custody staff and healthcare providers.

Common Allegations in Use-of-Force Litigation

These matters often involve claims such as:

Wrongful death or serious bodily injury

Failure to provide adequate medical care after force

Deliberate indifference to medical distress

Inadequate monitoring or emergency escalation

Systems failures in post-incident clinical response

We provide objective, evidence-based analysis grounded in correctional healthcare standards.
